Scientology's Fair Game

The "Moxon" named here is the notorious criminal KJendrick Moxon who was named as one of the many unindicted co-conspirators in Scientology's Operation Snow White. The Scientology crime syndicate likes to claim that all of the criminals captured and named in the series of raids against their enterprise in 1977 were "thrown out of Scientology" and yet here we see just one of the many co-conspirators still running the criminal enterprise, engaging in its usual racketeering.

The "Kobrin" creep is also just as notorious as Moxon. She's the criminal that engaged in the illegal attempt to remove the alt.religion.scientology newsgroup. The "Ava Paquette" criminal is the one that filed a fraudulent complaint with AT&T about an anonymous Scientologist by the name of "Mr. Safe" who was exposing Scientology's altering of "Scientology Technology" so that the criminal enterprise could acquire the identity of Mr. Safe to silence him -- which they did.

Together these three -- with their equally notorious fellow ringleader Eliot Abelson of the Gambino Mafia -- send baseless Fair Game racketeering complaints out on the Internet in an endless attempt to try to silence the truth about the cult's core criminality.

This letter constitutes notice that one of Gospelcom.net's members, Apolegetics Index, has placed RTC's Advanced Technology works and the BPI works noted in the table above, on its web page on Gospelcom.net's web site without the authorization of our clients. These copyrighted works can be following under the following URL:

Gospelcom's member's action in this regard violates United States copyright law.

Accordingly, we request that these copyrighted works be removed immediately.

Our clients have obtained numerous permanent injunctions concerning Internet infringements of the same and similar copyrighted works. For instance, in May 1998, a jury in the United States District Court in San Jose, California assessed damages in the amount of $75,000 against a Mr. Henson for copyright infringement on the Internet. Mr. Henson was also permanently enjoined by the court against further infringements. A United States District Court in the state of Virginia granted judgment for damages, costs, and a permanent injunction related to similar copyright infringement. Permanent injunctions have also been entered in three additional U.S. cases.

Recent case law has likewise upheld the now settled proposition that an internet service provider "who, with knowledge of the infringing activity, induces, causes or materially contributes to the infringing conduct of another" may be held liable as a "contributory" infringer. A&M Records, Inc. v. Napster, Inc., 239 F.3d 1004, 1019 (9th Cir. 2001) (where the court found service provider, Napster, liable for knowingly permitting copyright infringement to continue occurring on its system); Perfect 10, Inc. v. Cybernet Ventures, Inc., 213 F.Supp.2d 1146 (C.D. Cal. 2002) (where court granted preliminary injunction in favor of copyright owner, holding that the service provider's failure to "expeditiously" remove copyright infringements from its system after being on notice of it, defeated the service provider's attempted to seek protection under the safe harbor under the Digital Millennium Copyright Act.)

Moreover, several of these same infringements have been removed immediately upon notice, by several internet service providers, including AOL, Microsoft, Yahoo!, Lycos and The-Spa.

I have a good faith belief, and in fact know for certain, that the posting of these works by your member on his or her web page was not authorized by my clients, any agent of my clients, or the law.

I declare under penalty of perjury that this information is accurate and that I am authorized to act on behalf of RTC and BPI in this matter.
