Scientology's Fair Game

The use of trademarked names on the Fair Gamed web site are covered in Title 15, section 1125, subsection (c), which can be reviewed at:

In extract:

(4) The following shall not be actionable under this section:

(A) Fair use of a famous mark by another person in comparative commercial advertising or promotion to identify the competing goods or services of the owner of the famous mark.

(B) Noncommercial use of a mark.

(C) All forms of news reporting and news commentary

The Fair Gamed web site has no commerical aspects and consists, as you can see, almost entirely of news reporting, news commentary, court documentation, and eye-witness testimony and descriptions of Scientology's Fair Game policy in action.

To continue Title 15, Section 1125 in extract:
